Welcome! By purchasing a product on Saimai.it, you are entering into a sales contract governed by Italian law.
I want to be entirely transparent about a principle that is fundamental to me: every notebook and paper object you find here is crafted entirely by hand. This means that slight irregularities, subtle colour differences, or millimetric variations are not defects; they are the tangible proof that you are holding a unique piece, not a factory-made product.
The prices displayed do not include VAT because my business operates under a flat-rate tax scheme. Rest assured, for any objective manufacturing issues, you are fully protected by a two-year legal guarantee. Please read the full details below.
1. Scope of Application and Acceptance
These General Terms and Conditions of Sale govern the offer, transmission, and acceptance of purchase orders relating to products sold on the website www.saimai.it, owned and operated by Laura Alfonsi acting as a sole trader (hereinafter referred to as "the Seller").
By completing the online checkout process, the customer (hereinafter "the Customer" or "the User") declares to have read, understood, and unconditionally accepted this contract. These terms may be updated periodically to reflect legislative changes; the valid version is always the one published on the website at the exact moment the order is placed.
2. The Artisanal Soul: Characteristics and Limitations
The true essence of Saimai lies in manual craftsmanship. Every product, from the notebooks to the bespoke paper objects, is the result of a meticulous artisan process involving hand-cutting, folding, stitching, and binding. The photographs on the website are intended to present the product beautifully, but cannot guarantee a millimetre-exact reproduction of the physical item you will receive.
By acknowledging this clause, the Customer explicitly accepts that:
-
Slight variations in colour tone, due to the natural behavior of pigments or differences in digital screen displays;
-
Minor irregularities in the paper's texture or slight asymmetries in the hand-stitched binding;
-
Physiological traces of manual craftsmanship do not constitute a lack of conformity or a defect under Article 129 of the Italian Consumer Code. Rather, they are defining characteristics that certify the artisanal nature and premium value of the handmade item. Consequently, the Seller will not accept warranty claims or formal complaints based on the natural occurrence of these aesthetic variations.
3. Prices, Invoicing, and Payment Methods
All sales prices displayed in the online catalogue are expressed in Euros (€). Laura Alfonsi operates under the Italian flat-rate tax scheme (Regime Forfettario, pursuant to Art. 1, paragraphs 54-89, Law 190/2014). As a result, the prices are exempt from Value Added Tax (VAT).
Shipping costs are not included in the product price; these are clearly calculated and displayed before the transaction is finalised.
For Users who require an official Electronic Invoice (B2B or B2C), it is mandatory to request it at the time of placing the order by providing a valid Tax Code (Codice Fiscale), VAT Number (Partita IVA), and/or E-invoicing Code (Codice Destinatario/PEC).
Saimai utilises the highly secure Shopify Payments infrastructure. The Customer's financial data is encrypted and managed exclusively by the destination banking networks; the Seller never has access to your credit card numbers.
4. Order Processing and Contract Formation
The order is considered confirmed, and the contract officially concluded, the moment the Customer receives the "Order Confirmation" email.
Because this is an artisanal studio, the Seller reserves the right to cancel an order if the specific raw materials required for its creation become temporarily unavailable. In such an event, the Seller will immediately process a full and complete refund of all sums paid by the Customer.
5. Legal Guarantee of Conformity
If the Customer is purchasing as a "Consumer" (i.e., for purposes unrelated to their trade, business, craft, or profession), they are fully protected by the Legal Guarantee of Conformity governed by Articles 128 and following of the Italian Consumer Code (D.Lgs. 206/2005).
This guarantee covers objective manufacturing defects (excluding those defined in Section 2) and structural damage that becomes apparent within 24 months from the date of delivery. In the event of a lack of conformity, the Customer is entitled to the repair or replacement of the defective goods free of charge. To activate this guarantee, the Customer must send a written complaint to info@saimai.it, attaching suitable photographic evidence of the defect, no later than 2 months after discovering it.
6. Dispute Resolution and Jurisdiction
This contract is governed in its entirety by Italian law. Any dispute arising from the interpretation or execution of these conditions will be subject to the following territorial jurisdiction:
-
For Consumer Customers (B2C): The mandatory competent court is that of the Consumer's place of residence or domicile, in compliance with Article 66-bis of the Consumer Code.
-
For Professional Customers (B2B purchases with a VAT number): The exclusive competent court is the Court of Padua, Italy.
Furthermore, the Seller wishes to inform Consumer Customers that the European Commission provides an online platform for Alternative Dispute Resolution (ODR), accessible at the following link: https://consumer-redress.ec.europa.eu/index_it. This platform serves as a tool to resolve disputes relating to online sales contracts fairly, quickly, and out of court.
7. Shipping, Delivery, and Right to Cancel
The conditions relating to timelines, shipping methods, and the exercise of the Right to Cancel (including the mandatory legal exceptions for "bespoke" or personalised products) are strictly governed by their respective policies ("Shipping Information" and "Returns and Refunds Policy"). These documents form an integral and substantial part of these Terms and Conditions.
8. Intellectual Property
All content present on the website www.saimai.it (including texts, exclusive notebook designs, images, photographs, logos, and graphics) is the exclusive property of Laura Alfonsi and is protected by Italian and international copyright and intellectual property laws. Any reproduction, alteration, or commercial use without express written authorisation is strictly prohibited.
9. Prohibited Uses, Typographical Errors, and Indemnity
It is strictly forbidden to use the website for unlawful purposes, to transmit viruses, or to attempt to extract data using automated systems (scraping) without authorisation.
In the event of obvious typographical errors regarding prices, promotions, or product availability, we reserve the right to cancel the order even after confirmation, subject to a full refund. Finally, the Customer agrees to indemnify and hold Laura Alfonsi harmless against any claims or demands made by third parties resulting from the Customer's breach of these Terms.
We may update these terms at any time. The valid version is always the one published on the site at the exact moment of your purchase.
